WASHINGTON, D.C. — Dozens of first- and second-generation diesel locomotives owned by Genesee & Wyoming railroads across the country will likely be scrapped as part of a legal settlement with the federal government after it was revealed that the corporation had violated the Clean Air Act.
The list of locomotives that were listed in legal documents includes many iconic types of locomotives, from SD7s on Oregon’s Portland & Western to B23-7s on the Ohio Central. As part of the deal, the locomotives cannot be sold or donated for preservation and instead must be “permanently destroyed.” Along with replacing 88 locomotives — at a cost of more than $42 million — G&W will have to pay a $1.35 million fine.
According to court documents, parts could be salvaged from the locomotives but the only way any of the locomotive frames could be used again was if they were completely rebuilt to Tier 3 or Tier 4 standards.
According to documents, G&W had rebuilt locomotives but they did not meet emission standards established by the U.S. Environmental Protection Agency. G&W also did not perform the required emissions-related maintenance or keep records of maintenance performed on the locomotives.
“By requiring locomotives to follow emissions standards, and requiring dozens of older, higher-polluting locomotives to be scrapped altogether, this consent decree reduces health threats from air pollution nationwide, particularly in those communities that live along railroad corridors,” said Assistant Attorney General Todd Kim of the Environment and Natural Resources Division.
